Fujairah Shariah court orders man to be stoned to death for adultery

I didn't think they still did that in the UAE

In Dubai, A Murderer or a Rapist gets 3-4 years in jail.

Where's the justice in that?

This country, not unlike some other Muslim countries, suffers from a legal system that is both confused and confusing. It’s ostensibly based on the Islamic Shari’a, but in effect the sentences issued by the courts for all sorts of violations are not from Islamic law; Otherwise we’ll have thousands of people walking the streets with one hand missing. However courts, probably depending on what district, city, and judge sitting the case that day (and yes, what kind of defendant on trial) can have widely different verdicts for very similar cases. The fact that this case was tried based on the mostly unused Islamic punishment for adultery for married people (which to prove it according to Shari’a requirements is made extremely difficult) shows the urgent need for a more effective, consistent, modern, rational and humane legal system in this country. It should be kept in perspective however, that this extraordinary death sentence, perhaps like most other death sentences pronounced by local court, will almost certainly not be carried out.

Just because the UAE government does not apply the Islamic punishment the way it supposed to be ... that doesn't mean it is right!

Non of the so called Islamic countries are applying the Islamic Sharei'a ... Only Saudia Arabia as far as I know does that ...

As far as the 3 local men who raped the british woman ... they might have escaped the government punishment, but they certainly won't escape Allah's punishement in the after life ....

Most probably a court of a higher instance will considerably soften a punishment to a year in jail with following deportation.

For those who are speaking in the name of Islam and those who r interested to learn:
This whole accusation is unIslamic! Stoning to death is talked about in a hadith only. It is not a verse in the Quran. Yes, lashing is in the Quran. But Islamic law follows that when there is a doubt about something related to Haddood or divine punishments then the law is not to be applied. There is doubt alone based on the fact that stoning is mentioned through a narrator. It is not a divine commandment.
But importantly, the police forcing themselves into these people's privacy is totally unIslamic. That is a sin in itself. Please, I am not saying what these people were doing is not a sin, as indeed it is. But this act occurred in private, not public, and in order to see some nakedness, not even the act itself, was a violation and improperly applied Islamic law. So, no one is in a position to say that a person who criticises how humans carrying out their own way of punishing is attacking Islam and does not understand Islam. This whole case is not Islamically based or sound, no matter who says so. This application is humanly constructed.

You are right ... this pubishement is mentioned in Sunnah and authentic sunnah is the second source of Islamic laws. There is Hadeeth mentioned in the book of (Bukhari) which is considered the most correct book after the book of Allah (Holy Quran). This is the Hadeeth in Arabic ...

حدثنا علي بن عبد الله حدثنا سفيان عن الزهري عن عبيد الله عن بن عباس رضي الله عنهما قال قال عمر : (لقد خشيت أن يطول بالناس زمان حتى يقول قائل لا نجد الرجم في كتاب الله فيضلوا بترك فريضة أنزلها الله ألا وإن الرجم حق على من زنى وقد أحصن إذا قامت البينة أو كان الحمل أو الاعتراف قال سفيان كذا حفظت ألا وقد رجم رسول الله صلى الله عليه وسلم ورجمنا بعده).

رواه البخاري

So please don't fall in the mistake of denying a command mentioned in an authenticated Hadeeth as the prophet Mohammed, peace been upon him, does not speak from his own desires ... he only speaking what Allah has told him to deliever to the people ...

Yes. The hadith says 'bayyinah' or evidence, but, in Islam .. an evidence cannot be collected this way. The Prophet (peace be upon him) also said: "faman abdaa lanaa safhatahu aqamna 3aliyhi al-hadd" (the ones who commit their crimes in public deserve the punishment). This 'crime' or sin was done in private, and one of the islamic fiqhi principles is "al-satr", that is "the protection of privacy". A police raid could be evidence in any other crime, maybe. But for a hadd (divine law), the way it is prescribed has to be applied in literal terms. Allah said: "bring four witnesses". This means (in every school of law) that if four witnesses had witnessed the act itself, then the punishment could be considered. Otherwise, people who accuse others without this EXACT procedure should be lashed (refer to the first 2 pages of surat al-noor for the verses). So, the punishment for adultry is there, but the rules have to apply!
Now regarding stoning versus lashing, this is not my opinion. This is the opinion of several scholars who considered the narration of ahaad (singular-chained narration, even if it were in al-bukhari collection) - they considered this in itself a shubhah (a doubt), and the Prophet (s) had said: "idra`u al-hududa bel-shubuhat" (Do not administer the hudud if there is a doubt). Another doubt is the application of these punishments ONLY on non-citizens, even though everybody kows that zinaa is all over the place in the Arab gulf, but the punishment is ONLY applied on the weak. This is another "shubhah"!!

To the anonymous troll, if you are so concerned then why not be brave enough to reveal yourself. Truth be told, your biggest worry is perhaps this use of sharia will spread and spoil the fun of the fornicators. But if Allah wills it, than how will you stop it?
